In NY State it is illegal to smoke in any building that contains employees.

I saw that last night and I was astounded, Stephen Colbert asked him to stop smoking, he said that both of his parents smoked while he was growing up but that people CARE about him and that it is not good for him.  He put a cigarette out and lit another one shortly thereafter.  It really was surprising to see someone smoking on a talk show even though it used to be the norm.

That is surprising it amazes me that they let him on air but maybe they didn't know he would light up ! They couldn't very well kick him off the show !
